By using our site you agree to be bound by these Terms of Use, regardless of whether or not you choose to register with us, and in particular you agree and accept the disclaimers and limitations of liability contained in these Terms of Use. IMPORTANT DISCLAIMER: This web-based consulting service (“the “Service”) is provided for educational purposes only. By using the Service and accessing our site, you expressly acknowledge and understand that there are risks and limitations associated with this type of web-based consulting Service. The Service provided by Petnip.com, LLC and televets.com is not a substitute for the regular veterinary care for your cats, dogs or other pets, that a licensed veterinarian provides through regular, routine in-person office visits. Due to the nature of the Service, Televets has not verified and cannot verify the accuracy or truthfulness of any of the information provided on any of the Consultant/Advisor Profiles. The terms “Consultant” or “Advisor” may be used throughout our Site to identify an individual who claims to have certain knowledge, background, or experience that may be useful in responding to questions posed by Users. Use of such terms provides no assurance by us that the person answering a User’s question(s) has any expertise or qualifications to give such advice. Therefore, you acknowledge that we have not and cannot independently verify any User’s, Consultant’s or Advisor’s qualifications.

The Service is not a substitute for an emergency consultation facility and we do not and cannot provide advice or consultation regarding immediate emergency attention. If your pet has been in an accident, or is in immediate medical need, you need to contact your regular veterinarian or local animal hospital immediately.

Televets acts as a venue for entertainment purposes to allow anyone to ask or answer just about any question, at anytime, from anywhere. We are not involved in the actual conversation between any User and any Advisor or Consultant. We do not edit, modify, filter, screen, or otherwise monitor the content of questions, answers, profiles, qualifications or comments or have any obligation to monitor the content. As a result, we have no control over the quality, safety or legality of the answers given, the truth or accuracy of the answers, the ability of an Advisor or Consultant to answer questions or the ability of a User to pay for answers received. In the event that you have a dispute with one or more Users, Advisors, or Consultants, or suffer any damages as result of relying upon information on our Site provided by third parties, including any Advisor or Consultant, you release Televets (and our officers, directors, members, managers, agents, parents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes or damages. If you are a California resident, you waive California Civil Code §1542, which provides: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR"

1. Definitions and Introduction

1. In these Terms of Use:
   1. “Content” means the design, text, graphics and other material on our site;
   2. "Users" or “User” means the users of our site collectively and/or individually as the context requires;

2. You may access some areas of our site without registering your details with us. Certain areas of our site are, however, only open to you if you register your details.

2. You are permitted to view, copy, download, print out and use the Content for your own personal non-commercial use.

6. Your Warranties

   1. you are over eighteen (18) years of age;

The Content on our site may contain inaccuracies or typographical errors and we do not warrant the accuracy and completeness of the Content. Parts of the Content may be out of date, and we do not make any commitment to update such material. We may make changes to the Content at any time without notice to you. It is your responsibility to review these Terms of Use and/or the Terms of Service periodically in order to review any changes.

Our site provides a forum for you to ask questions about your pet, its behavior and its wellbeing, and provides an opportunity for persons who claim to have knowledge and/or experience experienced in the areas to which your question relates (the “Consultants”or “Advisors”) to provide you with what they consider to be the answer to your question. PLEASE NOTE THAT WE DO NOT EMPLOY THE CONSULTANTS OR ADVISORS AND HAVE NO CONTRACTUAL RELATIONSHIP WITH THEM. The Consultants or Advisors use our site as a venue to link them with those Users asking questions. We merely provide a service that allows users and the consultants or advisors to engage in a dialogue. As such, WE ARENOT RESPONSIBLE FOR THE CONTENT OF ANY ANSWERS OR ADVICE PROVIDED BY SUCH CONSULTANTS OR ADVISORS, AND WE DO NOT IN ANY WAY GUARANTEE THE ACCURACY, ADEQUACY OR COMPLETENESS OF ANY ADVICE PROVIDED BY THE SUCH CONSULTANTS OR ADVISORS. You acknowledge that any answer or advice provided is completely the opinion of the individual Consultant or Advisor, and you agree that you rely on any answer or advice provided by such Consultant or Advisor entirely at your own risk.
3. We do not warrant or represent that:
   1. access to our site or any part thereof will be uninterrupted, reliable or fault free; or
   2. our site is free of viruses or bugs.
4. We exclude to the fullest extent permissible at law any and all liability howsoever arising for:
   1. any technical, factual, textual or typographical inaccuracies, errors or omissions on or relating to our site or the Content;
   2. the unavailability of our site(or any part of it);
   3. any misrepresentation on or relating to our site or Content (other than a fraudulent misrepresentation made by us or on our behalf).

NEITHER WE NOR ANY OF OUR DIRECTORS, MANAGERS, MEMBERS, EMPLOYEES OR OTHER REPRESENTATIVES WILL BE LIABLE WHETHER IN CONTRACT, TORT, NEGLIGENCE OR OTHERWISE, FOR ANY LOSS OR DAMAGE WHATSOEVER AND WHETHER DIRECT OR INDIRECT ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SITE AND/OR THE CONTENT, INCLUDING, WITHOUT LIMITATION, DAMAGE TO SOFTWARE OR HARDWARE, ECONOMIC LOSS, LOSS OF DATA, CONSEQUENTIAL DAMAGE, LOSS OF OR DAMAGE TO PROPERTY OR PERSONS OR PETS AND CLAIMS OF THIRD PARTIES.

Please note that any disclosure of financial information by you (including, but not limited to, credit card, debit card and bank account details) when obtaining services via our site shall be via the PayPal Pro system. As such, we shall not at any time have access to such financial information. For the avoidance of doubt, we do not accept any liability whatsoever for any disclosure of any of your financial information via the PayPal Pro system, or any loss or damage you may suffer as a result of such disclosure.
7. None of the exclusions and limitations in these Terms of Use are intended to limit any rights you may have as a consumer or other statutory rights which may not be excluded nor in any way to exclude or limit our liability to you for death or personal injury (which for the avoidance of doubt does not include death of or personal injury to animals) resulting from our negligence or that of our agents or employees.
8. Each of the above exclusions and/or limitations shall be construed as a separate and severable provision of these Terms of Use.

8. Links to and From Third Party Websites

1. We may from time to time provide links from our site to third party Websites, including, but not limited to, those listed in our ‘Links’ section. We will not be liable in any way whatsoever and we make no representations, warranties, recommendations or endorsements in connection with the availability of any such Website or any content, advertising, products or services on or available from such Websites. If you decide to access any of the third party Websites linked to our site you do so at your own risk.
2. If you would like to create a link to our site you may contact our customer services (support@televets.com) – please include the words “link exchange” in the subject bar) to request a link. You may only link to our site on the basis that you link to the links page of our site and subject to the following conditions:
   1. you do not create any frame or any other browser or border environment around our site;
   2. you do not in any way imply that we are endorsing any products or services other than our own;
   3. you do not misrepresent your relationship with us nor present any other false information about us;
   4. you do not use any of our trade marks, logos or other intellectual property displayed on our site without our express written permission;
   5. you do not link from a website that is not owned by you; and
   6. your website does not contain information that is distasteful, offensive or controversial, infringes any intellectual property rights of any third party or otherwise does not comply with all applicable laws and regulations.
3. We reserve the right to revoke the right granted in paragraph 8.2 above in the event of breach of these terms and to take any action we consider necessary, including the removal of any link between our site and yours.
4. You agree to fully indemnify us for any loss or damage suffered by us for breach of paragraph 8.2.

However, the Internet is not a completely secure medium and, as such, you acknowledge and agree that, to the fullest extent permitted by law, we shall not be responsible for any unauthorized use, distribution, damage or destruction of personal data held by us.

Other than personal information covered under our Privacy & Security Policy, any material you transmit or post to our site shall be considered non-confidential and non-proprietary, and we shall have no obligations with respect to such material. We and others authorized by us shall be free to copy, disclose, distribute, incorporate and otherwise use such material and all data, images, sounds, text and other things embodied therein for any and all commercial or non-commercial purposes.

1. Each registration is for a single User only. You are not permitted to share your username and password with any other person nor with multiple users on a network.
2. Responsibility for the security of any password relating to your registration rests with you.
3. We reserve the right at any time without notice to disable your account on our site and/or to revoke your registration if in our sole opinion you have failed to comply with any of the provisions of the Terms of Use.

2. These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, USA, and you agree to submit to the exclusive jurisdiction of the courts of California USA.
3. We shall not be liable for any failure for any suspension, or termination of access to our site or any content arising out of a force majeure event.
